1. Vehicle Rental Agreement

All vehicle rentals are subject to a separate, legally binding Rental Agreement. This agreement will be provided to you at the time of booking confirmation or vehicle collection and will contain specific terms, conditions, insurance details, charges, and your obligations as the hirer. In the event of any conflict between these Website Terms of Service and the specific Rental Agreement, the terms of the Rental Agreement shall prevail.

2. Eligibility and Requirements

To be eligible to rent a vehicle from Falkirk Vehicle Rental Services, you must:

Be at least 21 years of age (minimum age may vary for certain vehicle categories or insurance purposes).
Hold a valid, full driving licence appropriate for the vehicle category you wish to rent. This licence must have been held for a minimum period, typically 12 or 24 months, free from major endorsements.
Provide valid identification (e.g., passport, national ID card) and proof of address (e.g., utility bill dated within the last 3 months).
Provide valid payment information for the rental charges and a security deposit. The security deposit amount will vary depending on the vehicle type and rental duration.
Meet any other specific criteria or requirements as detailed in the Rental Agreement or as requested by our staff.

3. Booking and Payment

Bookings can be made via telephone or through our official website. All bookings are subject to vehicle availability.
A booking deposit may be required to secure your reservation, which will be clearly communicated at the time of booking.
Full payment for the rental period and the security deposit are typically required at or before the time of vehicle collection.
Additional charges may apply for late returns, excess mileage (if your rental is not unlimited mileage), fuel discrepancies, cleaning fees, or damages incurred during the rental period.

4. Vehicle Condition, Collection, and Return

Upon collection, you are required to thoroughly inspect the vehicle for any existing damage and ensure it is accurately recorded on the vehicle condition report. Any discrepancies must be reported to our staff immediately before departing.
The vehicle must be returned in the same condition as it was rented, allowing for fair wear and tear.
Vehicles must be returned with the same fuel level as collected. A refuelling service charge, in addition to the cost of fuel, will apply if the vehicle is returned with less fuel.
Late returns may incur additional daily rental charges. Please contact us as soon as possible if you anticipate a delay in returning the vehicle.
You are solely responsible for any parking fines, speeding tickets, congestion charges, or other penalties incurred during the rental period.

5. Insurance and Liability

Basic third-party insurance is included as standard with all our vehicle rentals. Full details of the insurance coverage, including any excesses, will be provided in the Rental Agreement.
Additional insurance options, such as Collision Damage Waiver (CDW) or Super Collision Damage Waiver (SCDW), may be available to reduce your financial liability in the event of damage or theft. These options will be explained at the time of booking or collection.
You remain responsible for any damage, theft, or loss of the vehicle up to the applicable insurance excess amount, as specified in your Rental Agreement.

6. Cancellations and Amendments

Our cancellation and amendment policies vary depending on the type of vehicle and the notice period given. Specific details regarding your booking's cancellation and amendment terms will be clearly stated in your booking confirmation and the Rental Agreement. Late cancellations or failure to collect the vehicle (no-show) may result in the forfeiture of any deposits paid or incur additional charges.

7. Prohibited Uses

You agree not to use the rented vehicle for any of the following purposes:

Any illegal purpose or activity, including but not limited to transporting illegal substances or engaging in criminal acts.
Racing, off-roading, rallying, or any other hazardous or competitive activities.
Transporting hazardous, flammable, explosive, or otherwise dangerous materials.
Sub-renting the vehicle to any third party or allowing any unauthorized person to drive the vehicle.
Driving under the influence of alcohol, drugs, or any other substance that impairs your ability to drive safely.
For any purpose for which the vehicle is not designed or intended (e.g., using a car for heavy commercial hauling).
Carrying more passengers than the vehicle is legally licensed to carry.
Towing other vehicles or trailers unless explicitly permitted in writing by Falkirk Vehicle Rental Services and specified in the Rental Agreement.

8. Limitation of Liability

To the maximum extent permitted by Scottish law, Falkirk Vehicle Rental Services will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; (c) any content obtained from the services; and (d) unauthorized access, use or alteration of your transmissions or content. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Scottish law.

9. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Scotland.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
